9Finite Solutions ("we", "us" and terms of similar meaning) provides HRMS Service (in these terms we call this site and any successor websites, and any software provided by 9Finite for use with the site, the "Site") to you subject to these terms and conditions of use (these "Terms"). Please read these Terms carefully before using the Site. By accessing or using the Site or by merely browsing the Site you agree to be legally bound by these Terms and all terms, policies and guidelines incorporated by reference in these Terms. If you do not agree with these Terms in their entirety, you may not use the Site. The term "you" refers to the user or viewer of our Web Site. This Site is not intended to be used by children. You must be at least of the age of majority to use this Site.

ACCEPTANCE

By accessing or using the Service you agree to these Terms. This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior agreements, representations, warranties and understandings with respect to the Site, the content, products or services provided by or through the Site, and the subject matter of this Agreement. This Agreement may be amended at any time by us from time to time without specific notice to you. The latest Agreement will be posted on the Site, and you should review this Agreement prior to using the Site.

SERVICE DESCRIPTION

We provide a cloud-based HRMS platform enabling organizations to manage employee records, attendance, and payroll via mobile, desktop and web apps.

ACCOUNTS & ACCESS

  1. Users must provide accurate information and keep credentials secure.
  2. Clients are responsible for user provisioning and authorizations within their organization.
  3. We may suspend or remove accounts for violations or security concerns.

DATA OWNERSHIP

All HR and employee data entered into the Service is owned by the Client. We act as a processor and do not claim ownership of Client data.

FEES & PAYMENT

Access to the Service is subject to separate subscription agreements. Fees, billing cycles, and termination rights are governed by those agreements.

INTELLECTUAL PROPERTY

All software, content, and materials provided by 9Finite Solutions are our intellectual property. Clients receive a limited, non-exclusive license to use the Service during the subscription term.

WARRANTIES & DISCLAIMERS

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, whether express or implied.

LIMITATION OF LIABILITY

9Finite Solutions is not liable for indirect, incidental, special, or consequential damages, including lost profits, data loss, or business interruption.

We and any Affiliated Party shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting in any way from

  • any errors in or omissions from the Service or any services or products obtainable there from
  • the unavailability or interruption of the Service or any features thereof
  • your use of the Service
  • the content contained on the Service
  • any delay or failure in performance beyond the control of a Covered Party.

THE AGGREGATE LIABILITY OF US AND THE AFFILIATED PARTIES IN CONNECTION WITH ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE AND/OR THE PRODUCTS, INFORMATION, DOCUMENTS AND SERVICES PROVIDED HEREIN OR HEREBY SHALL NOT EXCEED Rs. 1,000/- AND THAT AMOUNT SHALL BE IN LIEU OF ALL OTHER REMEDIES WHICH YOU MAY HAVE AGAINST US AND ANY AFFILIATED PARTY.

TERMINATION

We may suspend or terminate access for breaches of these Terms or for non-payment. Upon termination, data handling will follow the Privacy Policy and the relevant commercial agreement.

GOVERNING LAW

These Terms are governed by the laws of Maharashtra, India. Disputes will be resolved in the courts of Mumbai, India.

CHANGES TO TERMS

We may modify these Terms from time to time. Changes will be posted at 9finite.com/terms-conditions. Continued use after updates constitutes acceptance.
